1. Scope of application
The following general terms and conditions apply to the present business relation between the Ambiente Direct GmbH, Zielstattstr. 32, 81379 Munich, Germany, represented by CEO Sven Stubenrauch (hereafter Ambiente Direct) and the customer. Deviating terms and conditions by the customer, even if they are known, are not integral part of the contract unless Ambiente Direct explicitly consents to their validity in writing.
2. Contract conclusion
The display of products in our online shop does not represent a legally binding offer, but a non-binding online catalogue. After entering the complete order data you place a binding order for the products contained in your shopping basket by clicking the “Place your order“ button. The contract of sale takes effect with our order confirmation, delivery confirmation, or the delivery of the products. Should you not receive an order confirmation, delivery confirmation, or the delivery of the products within two weeks, you are legally no longer bound to your purchase.
A record of the contract is saved and can be requested by calling our ServiceCentre.
3. Prices and payment conditions
The prices displayed in our online shop include the legal VAT. So long as it is not stated differently, the prices refer to their individually displayed products, however excluding contents, accessories, and decorations. Standard packing is included.
Payments can be made via prepayment or credit card. Choosing prepayment will grant you a 3% discount.
Total invoice amounts of over EUR 1000.- require a down payment of 50% of the total invoice amount. When paying via credit card this occurs automatically by partial debiting.
In exceptional cases, to safeguard credit risk, Ambiente Direct reserves the right to deliver only after prepayment.
4. Delivery
Ambiente Direct is entitled to partial deliveries, as long as they seem reasonable and this act would not be expecting too much of the customer. Additional shipping costs will only arise if mutually agreed on specifically. Delivery times can be found in the order confirmation. This information is to be understood as a non-binding average value and represents working days.
5. Right of return
Should a product not meet your expectations, within Europe you have the possibility of returning it by sending it back within 14 days, unless you have purchased as a commercial or self-employed customer (commercial or business order).
This period of time starts the earliest with your receiving the delivered goods or a detailed instruction in writing.

Should the goods not be capable of parcel shipment (e.g. bulky goods), a demand of withdrawal in writing will suffice, for example as letter, fax, or e-mail. Ambiente Direct will then commission a suitable carrier service with the collection of the goods.

A timely despatch of the goods or the request to take back the goods will suffice in order to comply with the deadline. From EU countries other than Germany and Finland goods are returned at the customer‘s expense and risk.
In the event of an effective return, the contract is terminated and any payments made will be transferred back to the customer after receiving the returned products. In case of deterioration of the goods, equivalent compensation may be claimed. This does not apply if the deterioration of the product can be traced back solely to its inspection - as may be common in the retail store. You can also avoid compensation costs simply by not using the product and refraining from any action that could impair the product‘s value. To avoid damage during a potential return, please keep the original packing until you have reached your final purchase decision.
Excluded from this return policy are:
Orders made by firms and commercial orders.
Orders with invoice or shipping address outside of the European Union, particularly from Switzerland and Norway.
Products that have been customised in a special way to meet the customer‘s wishes (special custom-made designs).
For the return of goods eligible for parcel shipping please follow these steps to ensure a smooth procedure and our best possible service:
Report your return in writing to Ambiente Direct. Within two days you will receive return documents from us by mail (consisting of cover letter, return dispatch note, and package stamp).
Pack the goods to be returned as carefully as possible and enclose the completed return despatch note.
It is best to use the original packing for the return. This way the goods are ideally protected against damages in transit.
Stamp the package with the package stamp received by Ambiente Direct and post it at your nearest post office.
The value of the goods will be credited to your account as soon as they arrive in our warehouse and have gone through inspection.
Please note that complying with the described procedure is not required for an effective return. It merely enables an easy, fast, and cost-efficient transaction for both sides.
6. Warranty
The guarantee takes place according to the legal regulations. All damages occurring during the legal warranty period of two years starting with the delivery, including damages in transit, have a right to subsequent performance (according to the customer‘s wishes: removal of defects or new delivery) and, if the respective legal premises are met, a right to reduction or withdrawal, as well as compensation. Should the desired method of subsequent performance lead to disproportionate expenses, the customer‘s claims are limited to the other method of subsequent performance.
7. Title retention
Ambiente Direct reserves the title to all delivered goods until full payment is made.
8. Jurisdiction
German law applies to the exclusion of the UN purchasing law. Contracts with an objective which is unrelated to the professional or commercial activity of the beneficiary (consumer) are only governed by this applicable law if no protection is provided by mandatory statutory provisions in the consumer's country of habitual residence. As far as the customer is a merchant the city of Munich, Federal Republic of Germany, shall be the exclusive place of jurisdiction for any proprietary disputes arising directly or indirectly from this contractual relationship.
